If you surrender your home in Bankruptcy, how long can you stay?


 According to a post on Bankruptcy Law Network:

"Even if you choose to surrender your home as part of your Chapter 7, the automatic stay provision of the Bankruptcy Code still protects you, at least temporarily. At some point in the near future, the mortgage company will file a motion in bankruptcy court called a Motion for Relief from Stay in which they ask the Judge to lift the automatic stay so that they can pursue their state law remedies."

Bankruptcy Statistics


According to Best Case Scenarios Magazine Fall 2013 edition:

-Three in Five bankruptcies are due to medical bills.
- Nearly 10M American adults (19-64) will be unable to pay for basic necessities like rent, food and heat due to medical bills.
- 2012 saw a 13% decline in Consumer Bankruptcy from 2011
- January and June of 2013 saw a 13% decline from the same period in 2012.
- The 13% decline is estimated to continue throughout 2013.
